Foboha Sues Gram Technology for "Unfair Competition" 

 

On February 15, 2008, Foboha GmbH and Foboha US, Inc. ("Foboha") filed a lawsuit against Gram Technology, Inc., and its president, Jes Gram ("Gram"), charging  federal unfair competition and various state law claims based on Gram's public statements about its US and foreign patents and pending applications relating to in-mold assembly of molded products.  A copy of the complaint is attached.

 

Significantly, Foboha's complaint does not contest the validity or enforceability of any of Gram's presently issued or pending patent claims, including those approved in the recent reexamination requested by Foboha.

 

On February 19, 2008, Foboha's agents served the complaint on Jes Gram, just prior to his important presentation to the attendees of the Molding 2008 conference in San Francisco.

 

Jes Gram, president of Gram Technology, Inc., stated, "We believe this lawsuit is without merit, and we intend to vigorously defend against Foboha's claims."

Gram stands strengthened against the patent opposition filed by an opponent.

Scottsdale, September 14, 2006 – Gram Technology, Inc. announced today that it received a non-binding provisional opinion from the European Patent Office regarding the opposition filed by the opponent.

After considering the opponents objections to the Gram Patent NO. EP 1 058 612

The European Patent Office concludes in a non-binding provisional opinion that:

“Consequently, claim 1 as granted appears to fulfill the requirements of the EPC. The same reasoning applies mutatis mutandis to the subject matter of claim 10 as granted. Claim 10 as granted appears therefore to fulfill the requirements of the EPC. Claims 2-9 depend on claim 1 and therefore also appear to fulfill the requirements of the EPC.”
