12/03-2008:

Foboha Sues Gram Technology for "Unfair Competition" 

 

On February 15, 2008, Foboha GmbH and Foboha US, Inc. ("Foboha") filed a lawsuit against Gram Technology, Inc., and its president, Jes Gram ("Gram"), charging  federal unfair competition and various state law claims based on Gram's public statements about its US and foreign patents and pending applications relating to in-mold assembly of molded products.  A copy of the complaint is attached.

 

Significantly, Foboha's complaint does not contest the validity or enforceability of any of Gram's presently issued or pending patent claims, including those approved in the recent reexamination requested by Foboha.

 

On February 19, 2008, Foboha's agents served the complaint on Jes Gram, just prior to his important presentation to the attendees of the Molding 2008 conference in San Francisco.

 

Jes Gram, president of Gram Technology, Inc., stated, "We believe this lawsuit is without merit, and we intend to vigorously defend against Foboha's claims."
